The Firebeam Blue App is used in conjunction with your Firebeam Blue beam detectors to provide secure access for commissioning the beam.

For the purposes of these Terms and Conditions:
We, us, our, the Company means The Firebeam Company Limited.
You, your, user, users means the individual accessing or using the Firebeam Blue App, or the company, or other legal entity on behalf of which such individual or company is accessing or using the Firebeam Blue App, as applicable.
Device means any device (such as a smartphone or tablet) on which the Firebeam Blue App may be accessed and/or used.
Intellectual property rights means all patent rights, copyrights, trade mark rights, rights in trade secrets, database rights, moral rights, and any other intellectual property rights (registered or unregistered) throughout the world. - Introduction
These are the Terms and Conditions governing use of the Firebeam Blue App and the agreement that operates between you and us. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Firebeam Blue App and are binding upon such users. - Acceptance
The Firebeam Blue App is used in conjunction with your Firebeam Blue beam detectors to provide secure access for commissioning the beam.
Your access to and use of the Firebeam Blue App is conditional on your acceptance of, and compliance with, these Terms and Conditions. You agree to be bound by these Terms and Conditions by sliding the button when registering in the Firebeam Blue App. If you disagree with any part of these Terms and Conditions then you will not be able to access the Firebeam Blue App.
Your access to and use of the Firebeam Blue App is also conditional on your acceptance of, and compliance with, our Privacy Notice that outlines the types of personal information we collect when you register to use the Firebeam Blue App, as well as the steps we take to safeguard your information. - User Accounts
When you register to use the Firebeam Blue App, you must provide us information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of these Terms and Conditions, which may result in immediate termination of your use of the Firebeam Blue App.
You are responsible for safeguarding the password that you use to access the Firebeam Blue App.
You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your App login details. - Authorisations
The Firebeam Company Limited grants users a non-exclusive, Worldwide, and perpetual license to perform, display, and use the Firebeam Blue App. - Intellectual Property Rights
The Firebeam Blue App content, design, features and functionality are and remain the exclusive property of the Company and are protected by copyright, designs, trade mark, and other Intellectual Property laws of both the United Kingdom and foreign territories.
Our Firebeam Blue App content, design, features, functionality and our trade marks may not be distributed, modified, reproduced in whole or in part without our prior written permission.
Any other product and company names other than those belonging to the Firebeam Company Limited used in this App may be trade marks of their respective owners. Use of any licensees’ trade marks is done with permission and remains the property of the licensee. - Changes to the App
We reserve the right to change the App at any time, without notice, and publish updated versions on App stores. - Terminating this agreement
We may terminate or suspend your access to the Firebeam Blue App at any time, without prior notice or liability, at our sole discretion, if, without limitation, you breach these Terms and Conditions.
Upon termination, your right to use the Firebeam Blue App will cease immediately.
If you wish to terminate use of the Firebeam Blue App, you may simply discontinue using the App or select 'DELETE ACCOUNT' in the App Settings menu and entering your password. This removes your account details and you will no longer be able to use the Firebeam Blue App.
Sections 2 (Definitions), 10 (Limitation of liability), 11 (Disclaimer of warranties), 12 (Indemnification), and 15 (Governing law) will survive any expiration or termination of these Terms and Conditions. - Limitation of liability
The Firebeam Blue App is used at a user’s sole discretion, and no liability arises from use of, or inability to use, the Firebeam Blue App. For the avoidance of doubt and to the maximum extent permitted by law, in no event shall the Company or its suppliers be liable for any damage whatsoever (including, but not limited to, damages for loss of profits, loss of use, loss of data or other information, for business interruption, for personal injury, or loss of privacy arising out of or in any way related to use of, or inability to use, the Firebeam Blue App). - Disclaimer of warranties
The Service is provided to You "AS IS" and "AS AVAILABLE" and, with any faults and defects, without warranty of any kind. To the maximum extent permitted under applicable law, the Company, on its own behalf and on behalf of its licensees, or any affiliates and/or service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the Firebeam Blue App, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, the Company provides no warranty or undertaking, and makes no representation of any kind that the Firebeam Blue App will meet Your requirements, achieve any intended results, be compatible or work with any other software, applications, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.
Without limiting the foregoing, neither the Company nor any of the company's providers makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the Firebeam Blue App, or the information, content, and materials or products included thereon; (ii) that the Firebeam Blue App will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the Firebeam Blue App; or (iv) that the Firebeam Blue App, its servers, the content, or e-mails sent from or on behalf of the Company are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components. - Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Company, any licensees, and/or any affiliates, and their respective directors, officers, employees and agents, from and against any and all third party claims, actions, suits, or proceedings, as well as any and all losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) in any way related to the use of, or inability to use, the Firebeam Blue App. - Changes to this agreement
We reserve the right to change the agreement, at our sole discretion, at any time by reasonable notice. - Alternative Dispute Resolution
In the event of any dispute or disagreement with respect to these Terms and Conditions, you agree to enter into Alternative Dispute Resolution (“ADR”), including mediation, in good faith to settle such a dispute or disagreement. - Governing law
These Terms and Conditions, this agreement and your relationship with us will be governed by the laws of England and Wales, and the Courts of England and Wales will have exclusive jurisdiction to deal with any matter after ADR.
